Online Reporting Tool for Recycling Establishments

Overview

The West Virginia Department of Environmental Protection (DEP) has launched a new online reporting tool to facilitate compliance with House Bill 5006 passed during the 2024 legislative session. This legislation aims to enhance the state's recycling objectives and improve data collection for evaluating West Virginia's recycling rate. These reports are Due March 1 of each year.

Who is Required to Report?

Reporting is required for all recycling establishments (as defined in HB5006) in West Virginia that handle or broker reportable recyclable materials. These establishments must report the previous calendar year's data annually, including facility contact information and the types and amounts of reportable recyclable material handled.

The first deadline for submitting calendar year 2025 data is March 1, 2026.

Who is Not Required to Report?

HB 5006 outlines specific exceptions. Entities that are not considered "recycling establishments" and are therefore NOT required to report include:

  • Retail establishments that only bale cardboard or collect other materials for off-site shipping.
  • End users (such as paper mills or steel mills) that convert recyclable materials into new products.
  • Recycling establishments that send all reportable materials to another in-state recycling establishment.
  • Scrap metal dealers subject to §61-3-49.
  • Entities whose materials come from shredding or dismantling motor vehicles or parts.
