Understanding the Area Source Boiler NESHAP (40 CFR 63, Subpart JJJJJJ)

The EPA's Area Source Boiler NESHAP, finalized on May 20, 2011, regulates hazardous air pollutant emissions from industrial, commercial, and institutional boilers. Key points to note:

• New vs. Existing Status: The rule defines when a boiler is considered "new" versus "existing." Generally, a boiler constructed or reconstructed after June 4, 2010, is considered new.
• Fuel Switching: Switching fuels after June 4, 2010, can be considered a significant change that triggers new source status.
• Current Status: Please be aware that this rule is currently under review by the EPA.
