Water and Waste Enforcement

Overview

The Water and Waste (WW) section within Environmental Enforcement promotes compliance by providing assistance and / or enforcing permit conditions required of municipalities, solid waste facilities, industry and the public. WW continually works to advance to lawful management of solid waste and wastewater.

Responsibilities

Duties and responsibilities of the Water and Waste section of Environmental Enforcement include:

  1. Inspections: Perform inspections and sampling to determine the compliance status of facilities permitted by the Division of Water and Waste Management (DWWM).

  2. Enforcement: Utilize criminal, civil and/or administrative enforcement procedures to compel compliance when necessary.

  3. Citizen Complaints: Investigate citizen's complaints related to point and non-point water pollution (non-coal), solid waste management, open dumps, groundwater concerns, both industrial and construction stormwater.

  4. Spills and Emergency Response: Place top priority on response to spills and fish kills. Such incidents are investigated to determine the likely effect and extent of their impact, their source, and the responsible party. These investigations often entail close cooperation with local, state and federal agencies.

Publications and Manuals

NPDES Reporting Reference Manual

Compliance Monitoring personnel of the Department of Environmental Protection have noted that a number of NPDES facilities have misunderstood several permit requirements. It is hoped that this manual will provide information to the permit holders and plant operators in order to clarify common misconceptions and errors. Included are instructions providing assistance in the completion of the WV/NPDES Discharge Monitoring Reports (DMR) required by your WV/NPDES permit.  

Note: This manual is not a substitute for having a thorough knowledge of all the requirements of your NPDES permit. You must thoroughly read your permit and adhere to all requirements. It is teh permittee's responsibility to ensure DMR's are properly completed, records maintained, and that all permit requirements are upheld.  

Monitoring and Record Keeping

It is the permit holder's legal responsibility to provide accurate monitoring information and maintain records as required. Failure to uphold this responsibility is subject, but not limited, to the following liabilities, as noted in Section C.14 (or Appendix AI.14 in newer permits) of all WV/NPDES permits:  

  1. Any person who violates a permit condition implementing sections 301, 302, 306, 307, 308, 318 or 405 of the Clean Water Act is subject to a civil penalty not to exceed $10,000 per day of such violation. Any person who willfully or negligently violates permit conditions implementing sections 301, 302, 306, 307, 308 of the Clean Water Act is subject to a fine of not less than $2,500 nor more than $25,000 per day of violation, or by imprisonment for not more than 1 year, or both.
  2. Any person who falsifies, tampers with, or knowingly renders inaccurate any monitoring device or method required to be maintained under permit shall, upon conviction, be punished by a fine of not more than $10,000 per violation, or by imprisonment for not more than 6 months per violation, or by both.
  3. Any person who knowingly makes any false statement, representation, or certification in any record or other document submitted or required to be maintained under permit, including monitoring reports or reports of compliance or noncompliance shall, upon conviction, be punished by a fine of not more than $10,000 per violation, or by imprisonment for not more than 6 months per violation, or by both.
  4. Nothing in C.14 (or Appendix A.I.14) a), b) and c) shall be construed to limit or prohibit any other authority the Director may have under the State Water Pollution Control Act, Chapter 22, Article 11.

Industrial Facility Closure Guidance Document

Facility abandonment is a precursor to the creation of a Superfund site. These sites can cause environmental and human health hazards that can result in extremely high cleanup cost, health care cost and/or loss of habitat. In 1995 the West Virginia Department of Environmental Protection (WVDEP), Environmental Enforcement Section (EE) initiated a program of inspection to evaluate environmental impacts or potential impacts for industrial and manufacturing facilities, which are moving, closing, ceasing operations, or have been closed. The focus of this program is to ensure that a facility does not leave contamination or other environmental problems that the State or Federal Government will have to deal with under CERCLA, Superfund, or similar program. This document is to provide guidance to facilities that fall under this program.

Rules and Laws

WW promotes compliance by providing assistance and/or enforcing permit conditions required of municipalities, solid waste facilities, industry and the public. It works to advance the lawful management of solid waste and wastewater. It primarily enforces the WV Solid Waste Management Act (Chapter 22-15), the WV Water Pollution Control Act (CSR 22-11), and the WV Groundwater Protection Act (Chapter 22-12); and the regulations promulgated thereunder: CSR47-02, 10, 11, 58 and 59 and CSR33-1, 2, 3, 4, 5, 7, 8 and 9.

  • Construction Stormwater Best Management Practices Manual

    The purpose of this manual is to provide standardized and comprehensive erosion and sediment control management practices for implementation on construction projects throughout West Virginia. It is intended that this manual be used as guidance for developing sediment control plans for the West Virginia/National Pollution Discharge Elimination System General Water Pollution Control Permit for Stormwater Associated with Construction Activities. However, the use of other best management practices manuals may also be acceptable. The use of this manual is not a regulatory requirement. The goal is to reduce the water quality impacts of land-disturbing activities through the design and implementation of effective erosion prevention and sediment control.  

  • West Virginia Environmental Training Center

    The West Virginia Environmental Training Center provides training and technical assistance to wastewater and water professionals statewide. Operators, managers, inspectors, and technicians attend both certification courses and continuing education workshops offered throughout the year. About 75 programs per year are delivered to approximately 1,200 participants. Wastewater and drinking water operator certification courses are offered at many levels, usually twice a year.

  • Ohio River Valley Water Sanitation Commission (ORSANCO)

    ORSANCO operates programs to improve water quality in the Ohio River and its tributaries, including: setting waste water discharge standards; performing biological assessments; monitoring for the chemical and physical properties of the waterways; and conducting special surveys and studies. ORSANCO also coordinates emergency response activities for spills or accidental discharges to the river, and promotes public participation in programs, such as the Ohio River Sweep.

    You do not need to submit a Division of Natural Resources Stream Activity Application if you are removing floating woody debris or trash from the stream (i.e. tree limbs and trash blocking the mouth of a culvert or accumulating around the piers of a bridge) if this work can be performed from the stream bank without placing equipment in the stream or disturbing the streambed.
